Credit Card Fraud: N.J.S.A. 2C:21-6

h. Fraudulent use of credit cards.

A person who knowingly uses any counterfeit, fictitious, altered, forged, lost, stolen or fraudulently obtained credit card to obtain money, goods or services, or anything else of value; or who, with unlawful or fraudulent intent, furnishes, acquires, or uses any actual or fictitious credit card, whether alone or together with names of credit cardholders, or other information pertaining to a credit card account in any form, is guilty of a crime of the third degree.

Credit Card Fraud in NJ: A Third Degree Crime

As the above statute details, credit card fraud is a third degree indictable offense in New Jersey. As a result, these charged must be handled at the Superior Court in the county in which the offense was permitted. For example, if your fraudulent use of a credit card charge was allegedly committed in Fort Lee Borough, New Jersey, this case must be handled at the Bergen County Superior Court located in Hackensack. Third degree crimes have a presumption of non-incarceration if you have no prior criminal record.
